Understanding the Law - E-SIGN Compliant Electronic Signatures

On June 30, 2000, Congress enacted the Electronic Signatures in Global and National Commerce Act (”ESIGN” or “the Act”), to facilitate the use of electronic records and signatures in interstate and foreign commerce by ensuring the validity and legal effect of contracts entered into electronically. Yet many do not understand how their business can be compliant with the E-SIGN Act.

First we need to understand that E-SIGN (additional E-SIGN analysis here), in section 101(b) does not require people to use electronic signatures. When electronic signatures are used then Sub-section (c), in direct support of (b), requires a “Consumer Disclosure” that the consumer also “consent electronically, in a manner that reasonably demonstrates that the consumer can access information in the electronic form that will be used to provide the information that is the subject of the consent”.

As we can clearly see, the law outlines a two step process to signing files electronically. First, disclosure of the consumer’s right to use paper, which is followed by their consent to the electronic process. The second phase is the actual capture of the electronic signature.

Once the signature is captured the law directs its attention to the electronic record that has now been created. This aspect of the law, while often overlooked, provides the true power and cost savings of electronic signatures - the ability to STORE electronic files. Printing and storing a paper copy of the electronic record defeats the achievements of this law. It is the accessibility and cheap storage costs of electronic files that really amount to long term cost savings. Sub-section (d) details the retention of contracts and records. If a “statute, regulation, or other rule of law requires” the file to be retained then “that requirement is met by retaining an electronic record”.

Accuracy and availability are discussed in both (d.1.B) and (e). The record must be available to all parties involved; this is easily accomplished by allowing each signatory to save an electronic copy of the record on their own computer. The electronic record and signature created must be in a format that is both accurate and accessible. Meaning that the technology to read, display and transfer the record is of a generally acceptable form. This aspect of the law requires businesses to choose electronic signature services that provide them with flexibility.

PrivaSign provides a multi-step approach to “Consumer Disclosure”, by providing multiple disclosure messages to the signatory. Acknowledgement of this disclosure is captured as proof that the consumer was informed, and did accept to use an electronic process.

PrivaSign’s “electronic records” are compliant with both sub-section (d) and (e). PrivaSign stores all files for a minimum of 3 months. Additional storage maybe purchased or at anytime during the 3 months both sender and recipient may download the file so that they may be in compliance with any applicable laws. This downloaded file can be saved to their computer, saved to a portable medium (CD, DVD or others) or even printed to paper. PrivaSign captures file integrity hashes so that all parties can verify the integrity of saved files.

PrivaSign allows any file type to be electronically signed. This increases the availability of the electronic record as described in (d.1B) and (e) and gives each business the ability to select the best electronic format for their clients.

Surge Protector: A Simple Mechanism Description

A surge protector [AKA surge suppressor] is an electrical plug-in device designed to distribute safe electrical voltages to other electrical or electronic devices. Surge protectors resemble power strips in appearance; however, they are more sophisticated and deliver a constant, continuous power supply.

In addition to connecting multiple devices to a single power source, surge protectors provide protection from frequent problems that plague conventional utility power. The most common of these problems are surges (temporary increase of voltage) and brownouts (temporary decrease of voltage). These disturbances slowly degrade many power supply units and cause premature equipment failure. The rising demand on our nation’s power grids is causing more brownouts than ever before (Gamble; Power Protect Your Computer).

The Inside of a Surge Protector

Toroidal Choke Coil: The toroidal choke coil is an electromagnet wrapped in wire. It filters out line noise as the hot wire passes through it.

Metal Oxide Varistors (MOV’s): An MOV has three parts: a piece of metal oxide material in the middle and two semiconductors joined to the hot and ground wire. As a protective connecting unit it shifts unsafe voltage levels to the ground wire.

Neutral Wire: The neutral wire is common in modern wiring practices for safety. It is used in conjunction with the hot wire and the ground wire.

Hot Wire: The hot wire holds the passing current which contains excess voltage.

Fuse: A fuse is a resistor used to protect the wiring from getting too hot. Fuses “blow or burn out”, thereby preventing the electrical current from traveling further.

Ground Wire: The ground wire protects users from getting an electrical shock. It receives excess voltage from from the MOVs.
Most surge protectors contain a parallel circuit design whereby the extra voltage is fed away from the standard path to another circuit. Another design is a series circuit where the electrical current is slowed; moreover it detects high voltage, stores the electricity, and releases it gradually (Harris).

The majority of the electrical currents diversion is done through the metal oxide varistor or MOV. The MOV acts as a pressure-sensitive valve: based on the level of voltage, the electrons in the semiconductors behave differently either creating lower or higher resistance. When the voltage is correct, an MOV doesn’t do anything (Harris).

Specifications and Quality Considerations

Energy Absorption: Surge processors are measured in joules (the amount of energy they can absorb). The higher the number, the better the protection: 200 joules provides basic protection, 400 is good and 600 or high is superior protection.

UL1449: Standard rated by Underwriters Laboratories as the minimum protection standards for surge protectors. It rates suppressors by the amount of voltage passage they allow.

Protection Indicator: LED indicator as to metal-oxide varistors functioning. MOVs do not last forever - one lightening strike can fry them out.

Line Conditioning: Most surge protectors contain this feature. It filters out line noise using a toroidal choke coil to “condition” the current.

Power Switch: There are manual on/off power switches as well as circuit switches. Circuit switches are useful for keeping some components running while others are shut off.

Circuit Breaker or Fuse: A fuse is a resistor that can conduct current below a certain level. If the current is higher than acceptable, heat burns the fuse and cuts off the circuit. Breakers are more economical than fuses as they do not have to be replaced.

Protection Guarantee: Read the terms and conditions carefully! It is important to understand your consumer rights in the event of damage to devices your surge protector neglects to protect (Kozierok).

According to data published on Hewlett Packard’s website, recent statistics reveal 63 percent of all electronics casualties are the result of a power related problem. Most affected are devices using computer chips and high-speed microprocessors. Unprotected computers can suffer hardware degradation and extensive damage when exposed to power surges (Power Protect Your Computer).

The cost of a surge protector varies greatly depending on user needs. Basic models sell for as low as $10 but one should be cautious as to the capabilities these units offer.

NOTE: It is important to connect all peripheral equipment to the surge protector for complete protection. This includes phone jacks, modems, cables, and any other external devices that will receive electrical current.

Did You Really Mean It?

I pledge allegiance to the Flag of the United States of America, and to the Republic for which it stands: one Nation under God, indivisible,With Liberty and Justice for all. You’ve all said it in school, but did you really mean it, or did you just say it because you were told to, a real American says it with conviction and really means it.

It says that you’ll respect our land and it’s laws, if you desire to have the freedom that it provides, it says as long as we think as one entity, we can’t be divided or brought down, by saying it as a real American you are pledging to respect and defend our country, and it’s way of life, if you can’t even do something that simple, then get out.

In the pledge it says that if you respect our country, and follow it’s laws, then you will be afforded the freedoms and liberties that are due to you, and just think for a minute, that really is the case, you don’t need the proper paper work, just to drive across town, like you would in Russia, and the cops here can’t just lay a beat down on you because they want to like other places.

All you have to do to enjoy these freedoms, is have a little respect for our country, and how thing work here, and you will have the freedom that you deserve, but it also takes a lot of hard work to keep this a free country, and you have to do your part to, one of the most disrespectful things that I can think of is, people that move to our country, but are to lazy to learn the language.

Our American kids, should not be forced to learn Spanish in school, unless of course they want to learn it, they should be forced to learn our language, which by the way is English, if we were to move to their country, we’d have to learn their language, or just not talk to any of them, it’s just disrespectful.

By all means it’s disrespectful to move here, and the fly the flag of your country in the back window of your car for everybody to see, no wonder people get upset, a real American would get highly agitated about this, it’s just a hit below the belt, a hit where it hurts, and they don’t do it because they like this country.

There are two examples of blatant disrespect of our country, do you want me to keep going, because I can, they come here, and form their gangs, a bunch of people who deserve no rights, beat old ladies and take their SS checks, steal cars and dismantle them for profit, do burglaries, and believe me, they would be glad to hit your house next, shoot people for no reason, but for some reason we have to be nice.

In that last sentence are five more forms of disrespect for our country, and it’s way of life, and that’s just the tip of the iceberg, things will continue to get worse unless we do something about it, have you ever heard the definition of insanity, it’s do the same thing, the same way everyday, and expect a different outcome, just think about it, that is what were beginning to do here.

The most important rule in planning a youth fundraiser is to make sure that everybody has fun!

These ideas will work well for a youth group, a church young people’s group, non-profit group or a youth sports (e.g. football, baseball) group.

Here are seven ideas to get your fundraising started:-

Sales -if you type in “youth fundraiser” on any search engine you’ll find offers to sell cookie dough, pizza cards, scratch cards, candles, sports goods and plenty more. Depending on the age of the children and the type of group, the locality, consider which of these are likely to be well received in your area. Using existing contacts with family, neighbours and friends alone can be quite profitable.

Car wash - this can be a profitable way to raise funds. It will need good planning. A great free guide to organising a successful car wash event is available from www.carwashguys.com <http://www.carwashguys.com>, called “How to run a successful car wash fundraiser” and is written by Lance Winslow.

Fundraising auction - clear out the garage, spring clean the house, ask for donations - and then auction!. Publicise your auction well in advance around the neighbourhood, invite friends and family, have a printed list of auction items and get someone you trust to run the actual auction itself for you.

Sponsored event - such as a walk, sleepover, or 24 hour sports event - your young people will have their own ideas as to what they’d like to do!

Photos - arrange for a photographer to come for a day or evening. Book a time slot for families, children, publicise the event. Arrange a good level of commission on all photographs purchased and ensure plenty of flyers are available to distribute.

Website advertising - does your group have a website? Could you set up a free blog to keep people informed? If so, consider selling advertising space to local suppliers who may be interested - e.g. the local sports shop.

Dance/Disco/Live Music/Barbeque/Casino event - any event that will work for your locality. Obviously, some church youth groups might find a casino night inappropriate. However, most of these are suitable for young people to help to arrange and to attend.

For other ideas to raise money, get your group together and do a little brainstorming. Everyone will have ideas that they can contribute and this will help to get them involve in the fundraising effort.
Remember to follow some simple rules:-

  • Never go out fundraising alone, but always in groups of at least two.
  • Have some printed information about your project and how much you are planning to raise.
  • Involve as many friends and family members as you can - they will want to support what you are involved with.
  • Have fun!

Ovarian Cancer- It Whispers, So Listen

Ovarian cancer is the biggest killer amongst all of the female cancers. Nearly 80% of those treated for ovarian cancer will experience a recurrence. The chances of death within the first five years of treatment is nearly 50%, no matter if it is stage 2,3, or 4. These grim statistics are now a reality for my own life. I am an ovarian cancer survivor.

One reason ovarian cancer is so deadly is because it is very difficult to detect. Often, by the time it is diagnosed, the cancer has spread to other parts of the body. There is no reliable screening for ovarian cancer like there is for breast cancer and cervical cancer. It can only be detected through an exam by an Ob/Gyn. So, it is important for all women to make an effort to get those yearly exams.

There is a tumor marker,CA-125, in the blood that may show the presence of ovarian cancer. It is not used as a screening procedure because it is not reliable enough. However, in cases where a woman is at a high risk, the CA-125 marker may be used to alert a Dr. for further testing.

A woman’s worst nightmare is the diagnosis of cancer. Yet, early detection is the best way to prevent any cancer from spreading and growing. Take care of yourself and take the time to get your yearly exam. It could save your life.

One of the Biggest Fears appears to be the fear of drowning. Unfortunately when Hurricanes Strike more people die of drowning than from the wind itself or something falling on them. The fear of drowning appears to be universal to all humans. People do not want to drown to death. The fear of drowning comes almost as high as the fear of being burned to death from the actual flames. Generally in structure fires folks die from smoke inhalation well before they actually burn.

More people in natural disasters die from drowning than any other way. Even Earthquakes often take out dams and the water rushes in drowning victims who other wise would have made out okay. Needless to say drowning to death is a very common fear and one that you are not alone in having. Many of people worst bad dreams are said to be drowning nightmares. Even people who are good swimmers are afraid of drowning. It is a highly innate human fear indeed.

The fear of drowning is one fear, which is okay, because it is such a natural fear. In fact the US Navy Seal Teams spend a lot of time training to overcome the fear of drowning and those who cannot pass are expelled from the competition to become Navy Seal Team Members. If you fear drowning the most important thing is to know where this fear comes from if you wish to overcome it. Think on this.

Man from Nepal, 75, oldest climber to scale the Mount Everest

As he planned for the climb, Sherchan told reporters he wanted to inspire fellow senior citizens. He also said many Nepalese have established records on Chomolungma, so it was only fitting that the record for the oldest climber to reach the summit should also belong to a Nepali. Further, the decision to actualize a long-time personal goal left Min Bahadur Sherchan with some internal uncertainties, he cited the political actions of China and Nepal as providing the greatest adversity he faced on his journey. Bahadur Sherchan returned this week from Nepal after successfully climbing to the summit of Chomolungma or Mount Everest. Now that Andrew Brash has successfully scaled the tallest mountain in the world, he is once again ready to focus on his family. “Mt Everest this year became a political pawn,” he said with some frustration.

His first found him within 210 metres of the peak when his team stopped to help a fellow mountaineer who was left for dead. Two years later, Bahadur Sherchan, a University of Calgary alumni, returned to Everest to finish what he had started.

Hall was frostbitten and severely disoriented due to altitude sickness. Andrew Brash returned a hero to Calgarians. More than 3046 people have climbed to the summit since it was first conquered in 1953 by New Zealander Edmund Hillary, who died in January, and Nepal’s Tenzing Norgay.

This season Anthony Loeff the French mountaineer is reporting the scales for the Mount Everest after reaching the summit of Kilimanjaro in Tanzania earlier this year.

Min Bahadur Sherchan last attempt resulted in the rescue of Lincoln Hall, an Australian climber who was left by his team in the “death zone.”

Sherchan just 17 days away from his 77th birthday beat the age record set last year by 71-year-old Japanese teacher Katsusuke Yanagisawa.

However, he was all too aware of the potential dangers the mountain could bring. Certain parts of the climb are more dangerous than others and it is important for climbers to remain focused With the Chinese preparing for the impending summer Olympic Games, Bahadur Sherchan noted that the government’s actions hardly reflected the Olympic spirit. They basically coerced the Nepali government to not allow any climbers past camp two on the Nepali side. The 74-year-old man from Nepal is now the oldest person to have reached the top of Mount Everest. They flexed their muscles this year all the in name of the Olympic spirit, but it was hardly spirited at all.”

The Chinese were flying their airplanes over the mountain and had Chinese officials in Kathmandu. “The Chinese weren’t allowing anybody on the mountain. They ended up commandeering it for themselves, even though the mountain is shared by two countries. He was reported in good health as he began making his descent. Andrew Brash and four climbing guides reached the 29,035-foot (8,850-meters) summit of the world’s highest mountain early Sunday, said Ramesh Chretri, an official with Nepal’s ministry of tourism.
